These Terms make up the full agreement between you and Tekreant about your use of our site and services. Nothing else counts unless it’s in writing and signed by both of us or posted here as an update by Tekreant.

We take these Terms seriously. If you break any part of them, and it looks like that breach could cause us serious harm that money can’t fix, we have the right to ask a court to stop you immediately without proving actual damages or posting a bond. If that happens, any court action will be held in Texas, and by agreeing to these Terms, you consent to the courts there handling this matter. You also agree that court papers can be served by mail or as allowed by law.
Most issues can be sorted out easily by reaching out to us. But if we can’t resolve a dispute, and except for cases where we seek emergency court orders as described above, you and Tekreant agree that any legal claim or dispute will be handled through binding arbitration one-on-one, not in court, and not as part of any group or class action.
This means there will be no judge or jury, and the arbitrator’s decision is final with very limited chances for appeal. You also give up the right to be part of any class action or group arbitration, and claims must be brought individually.
If you live in Texas, you still keep your right to seek public injunctive relief through the courts.
Arbitration will be governed by the Federal Arbitration Act and follow the rules of JAMS (an independent arbitration service). It will take place in the county and state where you agreed to these Terms, or another location convenient for you.
You are responsible for your initial arbitration filing fee, but we cover other arbitration costs as outlined by JAMS rules.
Special Rules for Mass Arbitration:
If many similar claims are filed (25 or more), special steps kick in to manage these efficiently, including selecting cases for early arbitration, mediation sessions paid for by us, and potential staged resolutions. Claims not chosen to proceed will not incur arbitration fees and may be resolved or withdrawn.
If you ever want to reject this arbitration agreement, you can do so within 30 days of accepting these Terms by emailing us at privacyofficer@tekreant.com with the subject line “Rejection of Arbitration Provision.”
If any part of this arbitration section is found unenforceable, the rest remains valid—unless the class action waiver is invalid, in which case the entire arbitration provision won’t apply, but the rest of the Terms will still stand.
Entire Agreement:
These Terms, along with any other applicable site policies, form the complete understanding between you and Tekreant about your use of our services. They override any previous agreements or discussions.
Governing Law and Venue:
These Terms are governed by the laws of Texas (excluding its conflict of laws rules) and U.S. federal law. Except where arbitration applies or is opted out, any legal disputes will be resolved exclusively in state or federal courts located in Texas.
No Waiver:
If we don’t enforce any part of these Terms right away, it doesn’t mean we waive our rights to enforce it later or any other part of the Terms.
Assignment:
You cannot transfer or delegate your rights or obligations under these Terms without our written consent. We can transfer or assign our rights and responsibilities freely, including your personal data, as explained in our Privacy Policy.
Headings:
Section titles are just for convenience and don’t affect how the Terms are interpreted.
